For the first time, many private-sector hospitals and other healthcare organizations are facing union organizing drives by physicians, residents, interns and other providers. Likewise, many healthcare employers are in labor negotiations with physician and provider groups for an initial collective bargaining agreement.

In this webinar, we will summarize threshold issues under the National Labor Relations Act that apply to physicians and other providers, including:

  • Application of the NLRB's Health Care Unit Rule
  • Application of the NLRB's single-site presumption
  • Supervisory and/or managerial exclusions based on physician self-governance models and committee composition
  • Dual function analysis for physicians who work at more than one system location

We will also examine the reasons why physicians and providers may seek unionization, especially given the trend of systemization of healthcare systems, and address strategies to correctly identify and manage legal considerations under the NLRA. Additionally, we will provide an update on collective bargaining negotiations to outline issues and trends that we are seeing for these groups at bargaining tables across the country.
